- The following conditions are the terms on which Used Stage Sound and / or New Stage Sound is prepared to sell goods (“the goods”) and on ordering or taking delivery of the goods from the seller you (“the buyer”) agree that they apply to the exclusion of your own terms (if applicable).
- Nothing in these terms and conditions shall affect your statutory rights if acting as a consumer.
- Force Majeure: the seller shall be relieved of his obligations under this contract insofar as he is prevented from performing them by any circumstances whatsoever, beyond the control of the seller.
- The seller reserves the right, by giving notice to you, the buyer, at any time before delivery to increase the price of the goods to reflect any increase in the cost to us, which is due to any factor beyond our control (such as and without limitation, any foreign exchange fluctuation, significant increases in the costs of equipment, significant increases in the costs of shipping).
- In the unlikely event of there being such an increase in the price of the goods you, the buyer, shall be entitled to cancel the order at any time before delivery.
- The goods will be delivered to you, the buyer, at the address provided by you at the time of ordering. If the delivery address is that of a third party we require further security checks to be carried out before despatch.
- The risk on the goods shall pass to you upon such delivery taking place. We accept no responsibility for loss if you instruct our courier to leave the goods at an insecure location.
- Any dates quoted for delivery of the goods are approximations only and we shall not be liable for any delay in delivery of the goods howsoever caused.
- Certain areas of the UK will carry a zonal surcharge as dictated by our courier. For the purposes of delivery the Channel Islands are deemed an international destination and will therefore be charged at appropriate rates.
- We shall not be liable to you, the buyer, for short delivery of the goods however caused, but will provide you with the outstanding goods as soon as is reasonably practical.
- The seller gives no warranty that the goods are fit for the buyer’s purpose(s). The buyer warrants that he will test the goods prior to use, that the goods will be used only by suitably qualified and experienced or competent persons and that the buyer is aware that the goods are supplied only for the purpose for which they were manufactured.
- Used equipment is sold as seen and no warranty is given or implied.
- In the event of any item being received damaged or faulty, the buyer should contact the seller within 3 working days of receipt.
- English law will apply to this Agreement, and the parties agree to submit to the jurisdiction of the English courts.
